VIOLATIONS

The violation process is designed to give homeowners several opportunities and a reasonable amount of time to resolve issues, prior to incurring possible fines.

In the event you receive an HOA Violation Notice from the Management Company (see contact details above), please read it and correct the issue immediately. It is advisable to contact Management Company directly to make property manager aware of your remediation.

If the violation persists, the process in place to address the matter is as follows:

VIOLATIONS PROCESS & PROCEDURES

  1. Identify violation during periodic community inspection.
  2. Send violation letter to homeowner.
  3. Check for resolution during subsequent community inspections.
  4. If violation is resolved before allotted time, mark file as resolved and check for reoccurrence during subsequent inspections.
  5. If violation is not resolved before allotted time, schedule a due process hearing and send homeowner a hearing letter.
  6. Check for resolution during subsequent inspections, prior to scheduled hearing
  7. If violation is resolved before hearing date, mark file as resolved and check for reoccurrence during subsequent inspections.
  8. If violation reoccurs, schedule a due process hearing and send hearing letter which states that "this hearing will not be cancelled, even if violation is resolved"
  9. Check for resolution during subsequent community inspections.
  10. Conduct due process hearing with Board present.
  11. Send hearing decision letter allowing an additional 14 days for resolution, before assessed fines begin.
  12. Check for resolution during subsequent community inspections.
  13. If resolved within the allotted time, do not assess fines.
  14. Check for reoccurrence during subsequent community inspections.
  15. If not resolved within allotted time, Collections Department will assess fines.
  16. Check for resolution during subsequent inspections.
  17. Once resolved, stop assessing fines.
  18. Check for reoccurrence during subsequent inspections.
  19. If the same violation reoccurs within twelve (12) months of the last hearing, begin assessing fines immediately and notify homeowner.
